NOS “Sturgis Bike Week 2008” Sweepstakes—Official Rules. No Purchase Necessary.

1. The “Sweepstakes Period” is from 12:01 AM, Eastern Time (“ET”), September 1, 2007 ("Game-Start") to 11:59 PM, ET, December 15, 2007 ("Game-End"). Time is based on Sponsor’s clock.
2. Eligibility: This Sweepstakes is open only to legal residents residing in the 48 contiguous United States who are the age of majority in their State of residence and older at the time of entry. Employees, officers, directors, agents, representatives and their immediate families (spouses, parents, children, siblings, and each of their spouses, regardless of where they live) or members of household of FUZE Beverages (“Sponsor”), LLC and THE MARKETING AGENCY, LLC (“Administrator”), their respective parent companies, subsidiaries, advertising, design, web design, web hosting, public relations and production agencies (the “Sweepstakes Entities”) and anyone connected with the production or distribution of this Sweepstakes are not eligible to enter or be awarded a prize.
3. How to Play: You will automatically receive one entry for doing any one of the following: (1) Going to, or clicking through on an advertising link to, www.DrinkNOS.com/SturgisVIPContest and registering with all the required information; (2) Clearly hand-printing your name, address, mailing address, daytime phone number and email address, for which you are the authorized user, on a piece of paper and mailing it in an appropriate envelope with first class postage along with a check or money order for $2.95, to: NOS “Sturgis Bike Week 2008” Sweepstakes, c/o Sweepstakes Redemption Center PO BOX 137, Worton, MD 21678. In addition to an automatic entry into the Sweepstakes you will receive a NOS Energy Drink T-shirt; (3) You may also enter by clearly hand-printing your name, address, mailing address, daytime phone number and email address, for which you are the authorized user, on a 3½”x5½” postcard and mailing it with first class postage to: NOS “Sturgis Bike Week 2008” Sweepstakes, c/o Sweepstakes Redemption Center PO BOX 137, Worton, MD 21678. “Authorized user” is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the email address. Mailed postcards and T-Shirt orders/entries must be postmarked by Game-End and received up to seven (7) days later to be entered in the Grand Prize drawing. Maximum one (1) entry per person or email address per day during the Sweepstakes period regardless of method of entry. Online entries must be made by an individual from a stand-alone computer and may not be made by proxy or any electronic/automated means such as script, bot, macro or any other similar software or program. All discovered entries made in violation of these Official Rules will be deleted.
4. Winner Selection: There will be one (1) winner selected in random drawings about 30 days after Game-End from all eligible entries received during the Sweepstakes period. Winner will be notified within five (5) days after the selection is made via email or USPS mail at Sponsor’s discretion to the email/address on the entry. It is an entrant’s responsibility to keep his/her email and mail addresses current. It will be a potential winner’s responsibility to respond to an email notification within 48 hours of email send-time and to a USPS mailed notice within seven (7) days. Failure to do so will indicate definitively that the prize has been declined for all time and another potential winner may be chosen in random drawings.
5. Quantity, Prize, Approximate Retail Value (ARV) and Odds: (1) Grand Prize: A 3-night trip for two (2) to Sturgis Bike Week 2008 consisting of: Roundtrip, coach airline travel for two (2) from the nearest gateway airport to winner’s residence to/from Rapid City, SD, (there may be stops or plane changes in both directions); standard, double-occupancy accommodation for three (3) nights at a hotel of Sponsor’s choosing (including hotel taxes); two(2) VIP tickets to the Sturgis Bike Week 2008 and “travel money” of $500. Winner will required to supply a valid, major credit card at hotel check-in to cover all expenses other than accommodations and related taxes as outlined above. Winner will be responsible for all other expenditures not specifically mentioned here including, without limitation, meals, gratuities, telephone charges, incidentals and personal expenses. The prize must be used on or about August 4 to August 10, 2008 or the prize, or a portion of prize, will be forfeited in its entirety without any compensation. Grand Prize will be awarded provided it is properly claimed. ARV: $2,100. Odds of winning the Grand Prize: Dependent on number of eligible entries received.
6. General: Sweepstakes administration and winner selection and verification will be supervised by THE MARKETING AGENCY, LLC, an independent judging organization whose decisions are final and legally binding. No participant or winner shall have the right to contest any decision by Sponsor or the independent judging organization concerning any aspect of the Sweepstakes or the interpretation of the Official Rules or the determination as to the qualification of entries. Only the prize and its listed value in the Official Rules shall be awarded. By participating in this Sweepstakes and submitting an entry, you agree to (i) be bound by these Official Rules including all eligibility requirements, and (ii) unconditionally release, discharge and hold harmless the Sweepstakes Entities and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives, their successors, estates and assigns (collectively, "Released Parties") one and all, from any and all liability, actions, causes of action, damages, actual, incidental or consequential, claims and demands whatsoever directly or indirectly, in whole or in part, in law or equity, including all “costs”, which he/she now has or may acquire, by reason of any personal injury, death, loss of or damage (e.g., to property), or any reason, occurring during or arising out of his/her participation in the Sweepstakes or the acceptance or use or misuse of any prize or any travel or activity related to the receipt or use of any Prize. By accepting a prize, winner (a) waives the right to 1) assert as a cost of winning the prize any and all costs of verification and redemption or travel to redeem said prize, or 2) claim any liability (including attorney's fees and costs) which might arise from redeeming or seeking to redeem said prize (including any travel related thereto). Grand Prize winner and travel companion are responsible for respecting all local regulations and for full compliance with the regulations of all venues. Sponsor, airlines, hotel and the race in Daytona administration have the right to refuse admission to anyone who does not comply with all regulations or comport him/herself properly. There will be no substitution or compensation for a prize or part of a prize forfeited due to winner's or winner's companion's non-compliance with venues’ regulations or any other reason. The right to receive the prize is non-assignable and non-transferable and no prize substitution, transfer, exchange or cash equivalent will be allowed except by Sponsor who has the right to substitute a prize or equal or greater value due to unavailability of the prize, Force Majeure or any other cause. The Grand Prize winner and his/her travel companion (who must be the age of majority and a legal resident of in hi/her state of residence) will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release and a Affidavit of Eligibility, Liability and Publicity Release (Travel Companion) respectively within seven (7) days of the date of notification if sent by USPS mail or three (3) days if sent by email or it will be concluded definitively that the prize has been declined and, without further notice, an alternative winner will be selected in random drawings. Prize or prize notification that is returned as undeliverable will disqualify the winner and an alternative winner will be selected in a random drawing. Sponsor is not responsible for those who cannot access the Internet or cannot click-through to the registration site for any period of time regardless of technical, hardware, software, Internet, virus contamination or network problems, and for delay, failure or malfunction for any reason including, but not limited to, lost or unavailable network connections, failed, incomplete or garbled computer transmissions, typographical or system errors, Force Majeure, human errors including, but not limited to, errors by Sponsor’s representatives. Sponsor reserves the right to cancel, terminate or modify the Sweepstakes if in Sponsor’s sole determination it believes that the integrity of the Sweepstakes has been, or could be, compromised or that the Sweepstakes is not capable of running as planned or fairly, including infection by network virus, bugs, tampering, unauthorized intervention, fraud, technical failures, Force Majeure or any other causes. Copies and other mechanical reproductions are not permitted for mail-in entries. Sponsor is not responsible for illegible, lost, late, misdirected, postage due, damaged or incomplete mailed entries. Proof of entry is not proof of receipt. In the case of early termination, a potential winner will be drawn from eligible applications received up to the time of cancellation and mailed entries postmarked up to the date of cancellation and received up to seven (7) days later. Sponsor reserves the right to disqualify any entry from the Sweepstakes if in Sponsor’s sole judgment entrant has not complied with these Official Rules. Without limitation, all of an entrant’s entries will be disqualified, at the sole discretion of Sponsor, if entrant attempts (i) to enter the Sweepstakes through any means other than as described in these Official Rules; or (ii) provides information that is inaccurate or fraudulent; or (iii) attempts to disrupt the Sweepstakes or circumvent the terms and conditions of these Official Rules. Sponsor assumes no liability for damage caused to entrant's or any other person /entity’s hardware, software or communications network, regardless of cause.
7. All federal, state and local laws, regulations and ordinances apply. Sweepstakes void where prohibited, licensed, restricted or taxed. If any provision of this Sweepstakes shall be deemed to violate any federal, state or local law, regulation or ordinance, it shall be amended to conform to such law and all other provisions shall remain in full force and effect. If Sponsor is required by applicable federal, state or local law, regulation or ordinance, or by action of an administrative agency to cease offering the Sweepstakes in any jurisdiction, Sponsor reserves the right to (i) terminate the Sweepstakes in such jurisdiction in its entirety, and/or (ii) cancel and remove from participation in the Sweepstakes any and/or all entries from entrants residing in such jurisdiction, without penalty and without obligation to any Sweepstakes entrants. An IRS form 1099 will be issued to the winner for the year 2007 for the ARV of the prize.
8. The Sweepstakes Entities shall not be responsible for technical, pictorial, typographical or editorial errors or omissions in any marketing materials or these Official Rules.
9. All materials submitted become the property of Sponsor and none will be acknowledged. Sponsor and Administrator collect personal information from you when you enter the Sweepstakes. The information collected is subject to the Sponsor’s Privacy Policies found at http://drinkfuze.com/privacy.html and the privacy policy of The Marketing Agency found at www.themarketingagency.com/html/aboutUs.html.
10. Acceptance of a prize constitutes permission to use the winner's name, voice and likeness and any and all identifying characteristics including, but not limited to, the taking of photographs and/or videos by Sponsor's photographer/videographer for publicity purposes, without further consent or compensation, unless prohibited by law and winner agrees to execute any and all documents requested by Sponsor to convey such rights to own all the results thereof. Nothing contained herein shall be deemed to obligate Sponsor to make use of any of the rights granted herein and winner waives any right to inspect or approve any such use of any and every nature and kind.
11. Except where prohibited, entrants agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys' fees; and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without regard for conflicts of law doctrine, and all proceedings shall take place in Bergen County, NJ.

No mechanically reproduced or photocopied requests allowed; only one (1) request per outer mailing envelope. You cannot enter the Sweepstakes using this address. Entries mailed to this address will be discarded.
